By accessing and using AssetTracker's asset management platform and services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.
These Terms & Conditions ("Terms") govern your use of our platform operated by AssetTracker ("us", "we", or "our").
2. Description of Service
AssetTracker provides a comprehensive asset management platform that enables organizations to track, manage, and maintain their assets throughout their lifecycle. Our services include:

- Barcode scanning capabilities
- Employee assignment and transfer workflows
- Maintenance and repair tracking
- Reporting and analytics
- Integration capabilities

3. User Accounts and Registration
3.1 Account Creation
To use our Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

5.2 Billing and Payments
Subscription fees are billed in advance on a monthly or annual basis. All payments are non-refundable except as otherwise stated in these Terms or required by law.
5.3 Free Trial
We may offer a free trial period. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.
5.4 Cancellation and Refunds
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial months or unused portions of the Service.
6. Data and Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

While we strive to maintain high availability, we do not guarantee that the Service will be available 100% of the time. The Service may be subject to planned and unplanned downtime for maintenance, updates, or technical issues.

We provide customer support through various channels as described on our website. Support availability may vary based on your subscription plan.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ASSETTRACKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Indemnification
You agree to indemnify, defend, and hold harmless AssetTracker and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of Kenya, with jurisdiction in Nairobi.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
15. Entire Agreement
These Terms constitute the entire agreement between you and AssetTracker regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
